Wills, Estates, and Estate Litigation

I provide legal services in wills and estates matters, including estate litigation, estate planning, and estate administration.

Estate litigation

I represent clients in estate disputes and related court processes, including:

  • Wills variation claims under British Columbia’s Wills, Estates and Succession Act (WESA).
  • Disputes about the validity of wills, including concerns relating to capacity, undue influence, and execution issues.
  • Disputes involving executors and estate administration, including accounting issues and passing of accounts.
  • Disputes arising on intestacy (where there is no valid will), including disagreements about entitlement and administration.
  • Steps that may be needed early in a dispute to protect interests while issues are resolved, including filing a notice of dispute to prevent an estate grant from issuing while the dispute is addressed.

Estate planning and administration

My work in this area may also include:

  • Preparation of wills.
  • Powers of attorney.
  • Representation agreements (personal planning documents under BC law).
  • Advice regarding estate administration and practical steps for executors.

For Indigenous clients, this can include estate planning and estate dispute work attentive to the interaction of federal and provincial regimes, including complexities that can arise in relation to reserve lands, non-member family members, and blended families.
